These Terms and Conditions of Sale govern subscription to MedNews, a medical watch service published by MedNews, trading name of Maxence Albertin, sole trader, company number 108 529 991, 848 avenue Gustave Charpentier, 83370 Fréjus, France, hereinafter « MedNews ».
Any subscription implies full and unreserved acceptance of these terms.
MedNews is a subscription medical watch service giving access to:
Prices are stated in euros. VAT is not applicable, article 293 B of the French general tax code: no VAT is charged and the amount taken is the final amount. MedNews reserves the right to change its prices at any time, provided it informs the subscriber at least 30 days in advance by email.
An invoice is issued with each payment and stays available from the account settings, under « My invoices ». It carries the details needed to claim it as a professional expense.
Payment is made by bank card through Stripe (PCI-DSS level 1 certified). The subscription is charged monthly on the anniversary date of the subscription, after the free first month has expired where it applies (see article 5).
If a payment fails, MedNews reserves the right to suspend access to the service until the situation is resolved.
The first month of subscription is free for any first subscription taken out within the month following account creation. No payment is taken during that period.
This free period does not apply to accounts that have already had more than one month of free access to the service, in particular accounts opened during the launch phase, nor to a new subscription following a cancellation. The subscription is then charged from its effective date.
In accordance with article L.221-18 of the French Consumer Code, the subscriber has a right of withdrawal of 14 jours from the date of subscription. To exercise it: contact@med-news.fr.
Immediate access to the service, accepted at sign-up, entails waiving the right of withdrawal for the trial period already used.
The subscriber may cancel at any time from their personal space or by contacting contact@med-news.fr.
Termination takes effect at the end of the current monthly period. No partial refund is made for the remaining period.
MedNews may terminate the subscription in the event of non-payment, breach of these terms or fraudulent use of the service.
The content published by MedNews is informative in purpose and does not constitute personalised medical advice. MedNews cannot be held liable for medical decisions taken on the basis of the information published.
MedNews undertakes to use all reasonable means to keep the service available, without being able to guarantee continuous, uninterrupted availability.
The service includes features connecting subscribers: directory, messaging, article sharing and public wall. They are intended for collegial exchanges about medical watch, professional practice and the organisation of practice.
They do not constitute neither a care management tool nor a secure health messaging system within the meaning of article L.1110-4-1 of the French Public Health Code. MedNews is not an accredited host of personal health data, and these exchanges must therefore never contain any.
The subscriber therefore undertakes not to include any data allowing a patient to be identified, directly or by cross-referencing: name, initials, date of birth, identification number, nor any image or document liable to allow their identification. A clinical situation may be mentioned only in an anonymised form that identifies nobody.
The subscriber remains solely responsible for observing the professional confidentiality by which they are bound (article 226-13 of the French Criminal Code, article R.4127-4 of the French Public Health Code). Sharing information covered by that confidentiality is lawful only between professionals taking part in the care of the same patient, and only to the extent necessary to them (article L.1110-4 of the French Public Health Code): the service does not constitute such a setting. For any exchange concerning an identified patient, the subscriber must use a secure health messaging system.
MedNews reserves the right to suspend or terminate access to the exchange features, or to the service itself, without notice, in the event of a breach of these rules.
All MedNews editorial content (summaries, syntheses, structuring) is protected by copyright. The subscriber has a strictly personal, non-commercial right of use. Any reproduction or distribution without authorisation is prohibited.
These terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent courts will be those of the Fréjus jurisdiction.
In accordance with article L.616-1 of the French Consumer Code, the subscriber may use consumer mediation. The appointed mediator will be announced before the commercial launch of the paid service.
